Description
Abdoul Jallow appeals from his conviction for delivery of cocaine alleging, among other things, prosecutorial misconduct. The prosecutor argued in closing that if the jury believed Jallow it would have to believe the police were liars. Although there was no objection and therefore no opportunity for the trial court to correct the error, the State concedes this argument was misconduct and that it was not harmless. In light of State v. Fleming, 83 Wn. App. 209, 921 P.2d 1076 (1996), review denied, 131 Wn.2d 1018 (1997), we accept the concession of error and agree that the proper remedy is reversal and remand for a new trial. In view of this disposition, Jallows remaining assignments of error do not need to be addressed.
